Terms of Service

Welcome to ARBK Atlas. By accessing or using our platform at arbk.atlas-studio.eu, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the service. ARBK Atlas is operated by Atlas Studio. These Terms constitute a legally binding agreement between you and Atlas Studio governing your use of the platform. ARBK Atlas is a business-to-business (B2B) service intended for use by companies, sole proprietors, analysts, sales teams, and other professionals. By creating a paid subscription, you confirm that you are subscribing in the course of your business, trade, or profession, and not as a consumer acting outside that scope. If you are not subscribing for business purposes, please do not complete the purchase.

The following definitions apply throughout these Terms: • Service — The ARBK Atlas platform at arbk.atlas-studio.eu, including the website, API, and all related features. • User — Any individual or entity that accesses or uses the Service. • Subscriber — A User who has purchased a paid subscription plan (Business or Enterprise). • Business Data — Publicly available business registration records sourced from ARBK. • API — The Application Programming Interface provided for programmatic access to Business Data. • Content — All text, data, graphics, and materials available through the Service. • NUI — Numri Unik i Identifikimit, the unique business identification number assigned by ARBK. • ARBK — Agjencia e Regjistrimit te Bizneseve ne Kosove (Kosovo Agency for Business Registration).

ARBK Atlas is a search and analytics platform that provides access to Kosovo's business registry. The Service includes: • Full-text search across 240,000+ registered businesses • Statistics dashboards and data visualization • Interactive municipality maps • Lead generation and business intelligence tools • Data export in CSV and PDF formats • API access for programmatic data retrieval We strive to maintain commercially reasonable uptime and performance. However, no uptime guarantee or Service Level Agreement (SLA) is provided for free-tier users. Paid plans benefit from priority support and best-effort availability targets.

To access certain features, you must create an account. When registering, you agree to: • Be at least 16 years of age. • Provide accurate and complete information. • Maintain the security of your account credentials. • Notify us immediately of any unauthorized access to your account. • Maintain only one account per person. You may register using Google OAuth or email and password. You are solely responsible for all activity that occurs under your account.

ARBK Atlas offers the following subscription tiers: • Free — Search with daily limits, 14-day data freshness delay, no export. • Business (€49/month or €449/year) — Unlimited search, interactive map, dashboard, owner network, risk scores, bulk lookup, market reports, exports up to 1,000 rows per request, 3-day data freshness delay. • Enterprise (custom pricing) — Real-time data, REST API access (rate limits agreed at signup), white-label options, custom integrations, dedicated support, SLA. Billing cycle: Business plans are billed monthly or yearly. Enterprise billing terms are agreed at signup. Active subscriptions auto-renew at the end of each billing period unless cancelled. Payment method: Billing details and accepted payment methods are arranged when your subscription is set up. Contact [email protected] to start a Business or Enterprise subscription. Cancellation: You may cancel at any time from /account/subscription (or by contacting us for Enterprise plans). After cancellation, you retain access to your plan's features until the end of the current paid billing period. Refunds: Subscriptions are non-refundable. Cancel from /account/subscription at any time to prevent the next renewal — your access continues until the end of the current paid period. See our Refund Policy for full details. Price changes: We will provide at least 30 days notice before any price increase takes effect.

Free-tier users are subject to the following limitations: • 50 searches per day (resets at midnight UTC) • 25 results per page • No data export • No API access • No access to premium features (map, dashboard, network, reports) The free tier is subject to a fair use policy. We reserve the right to limit or suspend access for users who engage in abusive usage patterns, including but not limited to automated searches, excessive requests, or attempts to circumvent daily limits.

API access is available on the Enterprise plan only. By using the API, you agree to the following: Rate limits: Daily rate limits are agreed as part of your Enterprise contract and set per API key at issuance. Contact us to negotiate a higher limit if your throughput needs change. API Key Security: Your API key is personal and must not be shared, published, or embedded in client-side code. You are responsible for all activity associated with your API key. Permitted uses: • Internal business intelligence and analytics • CRM enrichment and lead qualification • Market research and reporting • Integration with your internal business tools Prohibited uses: • Resale of raw data obtained through the API • Scraping or bulk extraction beyond your rate limits • Sharing API responses in bulk with third parties • Building a competing service using our API We reserve the right to revoke API access immediately for misuse, abuse, or violation of these terms.

When using ARBK Atlas, you agree not to: • Use automated scraping tools, bots, or crawlers to extract data beyond authorized API access. • Perform bulk data extraction by any means other than the provided API and export features. • Resell raw data obtained from the platform without adding substantial value. • Circumvent or attempt to circumvent rate limits, access controls, or security measures. • Share your account credentials or API keys with unauthorized parties. • Use the platform for any unlawful, fraudulent, or malicious purpose. • Harass, abuse, or threaten other users or Atlas Studio staff. • Reverse engineer, decompile, or disassemble any part of the platform. • Interfere with or disrupt the Service, servers, or connected networks. Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account without notice.

Business Data made available through the Service (including via search, export, bulk lookup, reports and the API) may contain personal data of natural persons — for example the names, roles and contact details of owners and representatives sourced from the public registry. When you access, export or otherwise process that personal data, you act as an independent data controller and you agree that: • You will comply with all applicable data protection laws, including the EU GDPR and Kosovo Law No. 06/L-082, and process the data only for a lawful, specified business purpose (such as due diligence, KYB/verification, credit and risk assessment, or B2B research). • You will not use the data for unlawful or unsolicited direct marketing, spam, harassment, profiling of individuals beyond your stated purpose, or any attempt to re-identify, enrich or combine it in a way the data subject would not reasonably expect. • You will not re-sell, redistribute or publish the raw data, or build a competing dataset or service from it. • You will honour data-subject rights and any suppression or erasure notice we issue. We maintain a delisting/suppression feed of records removed on request; you agree to reconcile against it and delete suppressed records from any copy you hold within 30 days. • You will keep the data only as long as necessary for your purpose and apply appropriate security. We may suspend or revoke your access immediately for breach of this section. These obligations are in addition to the API rules above and apply to all data obtained through the Service, including exports and reports.

Business data displayed on ARBK Atlas is sourced from the Kosovo Agency for Business Registration (ARBK) public records. Important disclaimers: • We do not guarantee the accuracy, completeness, or timeliness of business data. • Business information may change between our update cycles. • Data should not be used as the sole basis for financial, legal, or business decisions. • Users should verify critical information through official government channels. Atlas Studio is not liable for any losses, damages, or decisions made based on data obtained from the platform.

Platform: The ARBK Atlas platform, including its design, source code, branding, logos, and documentation, is the intellectual property of Atlas Studio and is protected by applicable copyright and trademark laws. Business Data: The business registry data displayed on the platform is sourced from public records maintained by the Kosovo government. Atlas Studio does not claim ownership of this public data. User Content: Content you create on the platform (saved searches, smart lists, preferences) is yours. By using the Service, you grant Atlas Studio a limited, non-exclusive license to use this content solely for the purpose of operating and providing the Service to you.

Data export capabilities vary by plan: • Free — Up to 10 rows per request, 50 rows per day. • Business — Up to 1,000 rows per request in Excel or PDF format, with a daily ceiling of 10,000 rows. • Enterprise — Up to 10,000 rows per request in Excel or PDF format, with a daily ceiling of 100,000 rows. Exported data may be used for your internal business purposes, market research, and commercial applications. However, you may not redistribute bulk data exports or create derivative databases for resale. Commercial use of insights and analysis derived from the data is permitted.

Your use of ARBK Atlas is also governed by our Privacy Policy, available at /privacy. The Privacy Policy explains how we collect, use, and protect your personal data. We use cookies for essential platform functionality and, with your consent, for analytics. Our practices are aligned with GDPR principles including data minimization, purpose limitation, and user rights. By using the Service, you acknowledge that you have read and understood our Privacy Policy.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Atlas Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill. Our total aggregate liability for any claims arising from your use of the Service shall not exceed the total amount you have paid to Atlas Studio in the 12 months preceding the claim. Force Majeure: Atlas Studio shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, government actions, network failures, or third-party service outages.

User-initiated: You may cancel your subscription and close your account at any time from your account settings or by contacting us at [email protected]. Atlas Studio-initiated: We may suspend or terminate your account if you violate these Terms. Where possible, we will provide notice before termination. Effect of termination: • Immediate loss of access to paid features. • Your personal data will be deleted within 30 days, subject to our data retention obligations. • Payment obligations for the current billing period survive termination. • Provisions regarding intellectual property, limitation of liability, and governing law survive termination.

Governing Law: These Terms are governed by the laws of the Republic of Kosovo. Dispute Resolution: Any disputes arising from these Terms shall be resolved in the competent courts of Pristina, Kosovo. Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect. Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Atlas Studio regarding the Service. No Waiver: Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision. Assignment: Atlas Studio may assign its rights and obligations under these Terms. You may not assign your rights without our prior written consent. Amendments: We may update these Terms from time to time. Material changes will be communicated via email to registered users at least 30 days before they take effect. Continued use of the platform after changes constitutes acceptance of the updated Terms.
