Acceptable Use Policy

This Acceptable Use Policy (“AUP”) applies to anyone accessing arbk.atlas-studio.eu, including any access via our public API, dashboard, exports, embeds or scheduled jobs.

It supplements, and forms an integral part of, our Terms of Service. Any violation of this AUP may result in throttling, suspension, or termination of your account, with or without prior notice depending on severity.

ARBK Atlas is a search and analytics layer over the public Kosovo business registry. You may use the service for any legitimate business purpose, including:

• Looking up businesses for due diligence, KYC, and KYB workflows;
• Investigative journalism and academic or non-commercial research;
• Sales prospecting and lead generation, where compatible with applicable data-protection law (including GDPR and Kosovo Law No. 06/L-082 on the Protection of Personal Data);
• Market analysis and competitive intelligence;
• Internal compliance, audit, and risk-management checks.

Business and Enterprise customers may incorporate ARBK Atlas output into their own internal workflows, dashboards, and tools, subject to the licensing constraints described below.

You must not, and must not permit any third party to, use ARBK Atlas for any of the following:

• Reselling, sublicensing, syndicating, or otherwise redistributing raw ARBK Atlas data or substantially-derived datasets to third parties;
• Building, training, or operating a product that competes with ARBK Atlas using ARBK Atlas exports, scraped pages, or API output;
• Bulk scraping, crawling, or harvesting outside the published API rate limits, or attempting to circumvent any rate-limiting, caching, or quota mechanism;
• Reverse-engineering, decompiling, or attempting to reconstruct ARBK Atlas risk scores, owner-network graphs, address-clustering output, or any other derived analytics;
• Using ARBK Atlas data to train, fine-tune, or evaluate machine-learning or generative-AI models without an explicit Enterprise data-licensing agreement signed by the operator;
• Sharing account credentials, session cookies, or API keys with any third party, including affiliates and contractors not named on the account;
• Sending unsolicited bulk commercial email, SMS, or other electronic communications (“spam”) using contact details obtained through ARBK Atlas;
• Making solely automated decisions about credit, insurance, employment, housing, tenancy, or any other matter that produces legal effects concerning a natural person or similarly significantly affects them, where such processing is prohibited by Article 22 of the EU GDPR and Article 22 of Kosovo Law No. 06/L-082;
• Discriminating against any person on the basis of race, ethnicity, nationality, religion, gender, sexual orientation, disability, age, or any other protected characteristic;
• Using ARBK Atlas as the sole control for sanctions, PEP, or watch-list screening — ARBK Atlas is not a sanctions-list provider and must not be relied upon as one;
• Submitting illegal content, defamatory statements, threats, harassment, or hate speech via the contact form, removal-request flow, or any other input channel;
• Circumventing security controls, attempting unauthorized access to accounts or infrastructure, conducting penetration tests or vulnerability scans without prior written permission from the operator;
• Using ARBK Atlas to violate any applicable law of the Republic of Kosovo, the European Union, or any other jurisdiction whose law applies to you or to the data subject.

Usage is metered server-side via our usage-log table and enforced per account, per API key, and per IP address. The current per-plan limits are:

Brief bursts above the steady-state limit are tolerated. Sustained excess, parallelized scraping, or any pattern that degrades service for other customers will trigger automatic throttling and may escalate to suspension.

The underlying business registry records are public data published by the Republic of Kosovo and are not owned by us. However, our enriched search index, full-text vectors, risk scores, owner-network graph, address clusters, and the search and analytics infrastructure that delivers them are protected by sui generis database rights analogous to those granted under EU Database Directive 96/9/EC, as well as by copyright and trade-secret law.

Subject to your compliance with this AUP and the Terms of Service, we grant you a non-exclusive, non-transferable, revocable license to use ARBK Atlas output for your own internal business purposes during the term of your subscription. No other rights are granted, by implication, estoppel, or otherwise.

If you believe someone is misusing ARBK Atlas, or that ARBK Atlas content violates your rights or applicable law, please email [email protected] with:

• The URL, endpoint, or NUI involved;
• The date and approximate time (with timezone) of the activity;
• The account email or IP address, if known;
• A clear description of the issue and any supporting evidence.

We acknowledge abuse reports within five (5) business days and will investigate in good faith.

Where a violation is identified, we generally proceed in the following escalating order:

• Warning email describing the violation and required corrective action;
• Temporary throttling of the offending account, API key, or IP address;
• Account suspension pending investigation or remediation;
• Account termination, with pro-rata refund only where required by law;
• Permanent ban via our blocked_emails table and JWT revocation through a token_version increment.

Severe violations — including security attacks, illegal content, sanctions-related misuse, or activity that endangers data subjects — may skip directly to step 5 without prior warning.

If your account has been throttled, suspended, or terminated, you may appeal in writing to [email protected] within thirty (30) days of the enforcement action. Your appeal should include the affected account email, a description of the action you are appealing, and any context you wish us to consider.

We will review and respond within fourteen (14) days. The final decision rests with the operator, without prejudice to any statutory rights you may have.

We may update this AUP from time to time to reflect changes in our service, in applicable law, or in observed abuse patterns. Material changes will be notified to active subscribers by email or via an in-app banner at least fourteen (14) days before they take effect. Continued use of ARBK Atlas after the effective date constitutes acceptance of the revised AUP.
